1. Ownership of Intellectual Property

All content, features, and functionality available on echosaw.com (the "Site") and through the Echosaw Media Intelligence product ("Echosaw" or "the Product"), including but not limited to:

• Software, source code, object code, algorithms, AI models (including trained weights, architectures, and inference logic), APIs, and underlying technology
• User interface designs, graphics, logos, icons, trademarks, service marks, and branding
• Text, reports, dashboards, visualizations, templates, and documentation
• Databases, data structures, metadata schemas, and aggregation logic
• Any AI-generated or AI-assisted outputs produced by Echosaw (subject to the disclosures in our AI Use and Disclosure Policy)

are owned exclusively by Orange Sky Software Inc. ("Orange Sky," "we," "us," or "our") or our licensors and are protected by United States and international copyright laws, trademark laws, trade secret laws, patent laws (where applicable), and other intellectual property rights.

2. Limited License Granted to Users

Subject to your compliance with our Terms of Service, AI Use and Disclosure Policy, Data Retention and Deletion Policy, Cookie Policy, Privacy Policy, and payment of all applicable fees, Orange Sky grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license during your active subscription term to:

• Access and use the Site and Echosaw solely for your internal business purposes (or personal use, where permitted under your plan)
• View, interact with, download, export, and store Generated Content (reports, summaries, insights, alerts, analytics) produced through your authorized use of Echosaw
• Use Echosaw outputs in your professional media intelligence, reporting, strategy, or decision-making activities

This license does not include any right to:

• Copy, reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, or commercially exploit any portion of the Site or Product (except as expressly permitted for your own exported outputs)
• Reverse engineer, decompile, disassemble, or attempt to derive the source code, AI model architecture, training data, or proprietary algorithms of Echosaw
• Use any robot, spider, scraper, or other automated means to access, monitor, or copy any content or data from Echosaw
• Remove, obscure, or alter any copyright, trademark, patent, or other proprietary notices
• Use Echosaw or its outputs to develop, train, or improve any competing media intelligence, AI, analytics, or monitoring product or service
• Sublicense, resell, rent, lease, or otherwise make Echosaw available to third parties (except as expressly allowed under an Enterprise plan with written agreement)

3. User Content and Generated Outputs

You retain ownership of any media, links, search queries, monitored terms, or other materials you upload, submit, or input into Echosaw ("User Content"). By submitting User Content, you grant Orange Sky a worldwide, non-exclusive, royalty-free license to use, process, store, analyze, and display such User Content solely as necessary to provide, maintain, improve, and secure the Product (subject to our Data Retention and Deletion Policy).

Generated Content (reports, summaries, insights, alerts, etc.) produced by Echosaw is licensed to you under the terms above for your permitted use. You may not claim ownership of the underlying AI models, processing logic, or templates used to create such outputs. Where outputs contain AI-generated elements, you must comply with the disclosure requirements set forth in our AI Use and Disclosure Policy.

4. Trademarks

"Echosaw", "Orange Sky Software", the Echosaw logo, and all related product and service names, designs, and slogans are trademarks, service marks, or trade dress of Orange Sky Software Inc. You may not use them without our prior written permission, except to accurately identify that you are a customer or user of Echosaw in accordance with any applicable brand guidelines we may provide.

5. Enforcement of Rights

Orange Sky vigorously protects its intellectual property rights. Unauthorized use, reproduction, distribution, modification, or reverse engineering of any portion of the Site or Product may result in civil and/or criminal liability. We reserve the right to suspend or terminate access, pursue legal remedies, and seek injunctive relief and damages for any infringement.

6. Reporting Infringement

If you believe that any content on the Site or within Echosaw infringes your copyright or other intellectual property rights, please submit a written notice to our designated agent in accordance with the Digital Millennium Copyright Act (DMCA) or applicable law. Notices should be sent to:

7. Updates

This Copyright and Intellectual Property Notice may be updated from time to time to reflect changes in law, technology, or our practices. Continued use of the Site or Echosaw after any update constitutes acceptance of the revised notice.
